(Montgomery, Ala) – Attorney General Steve Marshall joined an amicus brief in the United States Supreme Court supporting the religious rights of parents to object to vaccination requirements for their daughter who attends an online-only public school. Krystal and Anthony Perry believe that vaccinations developed from the remains of aborted fetuses violate their Christian faith. But a West Virginia school district has disenrolled the Perrys’ daughter because they refuse to vaccinate her, even though their daughter was attending online public school at home. Lower courts rejected the Perrys’ case, and a coalition of 16 attorneys general are encouraging the U.S. Supreme Court to take it.

“The Supreme Court has repeatedly affirmed that parents, not the government, have the right to raise their children according to their deeply held religious beliefs. No family should have to choose between their child’s public education and their faith, yet that is exactly what the Perry family is being forced to do. Last term, the Court reaffirmed that religious liberty is not something government can bargain away, and our coalition’s brief urges the Justices to take up this case and make clear that the First Amendment does not stop at the schoolhouse door or school login,” Attorney General Marshall stated.

Joining Alabama in the Nebraska-led brief are attorneys general from Alaska, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Louisiana, Missouri, Montana, Nebraska, South Carolina, South Dakota, Utah, and West Virginia.
